Terms and Conditions

Parting Hand (“the site”) is run by Hal Eisen, one person, not a company (“the operator”, “I”, “me”). These terms are an agreement between you and me. By using the site in any way, including only reading it, you agree to them. If you do not agree, please do not use the site. 1. What the site is, and is not
The site lets a person record the songs they would like sung at their funeral, and lets others read that record. It is not a will, a contract, a funeral plan, or legal, medical, or financial advice. It places no obligation on anybody, including me, to sing, arrange, or do anything. Nothing on the site creates any relationship between you and me beyond these terms.
2. Who may use it
You must be at least 18, or the age of majority where you live if that is higher, to create an account. You may hold one account, for yourself only. You may not create a page for, or pretend to be, anybody else, living or dead.
3. Your account
You sign in with a link sent to your email address. You are responsible for keeping that email account secure and for everything done through your account. I am not responsible for any loss caused by somebody else getting into your email.
4. What you publish
You keep ownership of what you write. By putting it on the site you give me a worldwide, royalty-free, non-exclusive, perpetual licence to store, copy, display, and publish it on the site and in its backups, for as long as the site runs, including after your death. You can take your page out of public view at any time; the licence then covers keeping it, not showing it.
You promise that what you publish is yours to publish, is accurate about you, and does not infringe anybody's rights, defame anybody, or break any law. You are solely responsible for it. I do not review pages before they appear and I am not responsible for what anybody publishes.
5. Things you must not do
- Publish anything unlawful, abusive, or about another person without their consent.
- Report a death you know or suspect to be false, or nominate a trusted contact without their agreement.
- Try to get into accounts or data that are not yours, interfere with the site, or overload it, including by automated means.
- Use the site to send messages to anybody who did not ask for them.
6. Trusted contacts and memorials
Anybody may report that a singer has died. Only the trusted contact that singer nominated can confirm it, and confirming turns the page into a memorial and locks it. I do not check who a trusted contact is, whether their address is correct, or whether a report is true. I act on what the people involved tell me, and I am not responsible for the result of a false report, a wrong or mistaken confirmation, or a trusted contact who cannot be reached. If a page is locked in error, write to me. It can be undone.
7. Changes, suspension, and ending
I may change the site, or suspend or end any account or page, at any time and for any reason, including a breach of these terms. The site may one day stop altogether. I will try to give notice where I reasonably can, but I am not required to.
8. No warranty
The site is provided free of charge, “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. I do not promise that the site will be available, secure, free of errors, or that it will keep your data. Do not rely on it as the only record of your wishes.
9. Limit of liability
To the fullest extent the law allows, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, distress, or failure of your wishes to be carried out, arising from your use of the site or anybody else's. My total liability for any claim connected with the site is limited to fifty US dollars (US$50). Some places do not allow some of these limits; where that is so, they apply as far as allowed.
10. Indemnity
You agree to defend, indemnify, and hold me harmless from any claim, demand, loss, liability, or expense, including reasonable legal fees, made by anybody else and arising from what you publish, a report or confirmation you make, your breach of these terms, or your breach of anybody's rights or of any law.
11. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute connected with the site will be heard only in the state or federal courts located in California, and you agree to their jurisdiction.
12. Changes to these terms
I may change these terms. The date at the top shows when they last changed. Using the site after a change means you accept the new terms.
13. The rest
These terms, with the privacy page, are the whole agreement between you and me about the site. If any part is found unenforceable, the rest still applies. If I do not enforce a term, I have not waived it. You may not transfer your rights under these terms; I may transfer mine to whoever takes the site on.
